Section 2 : Management of the structures. [12 hours ]

 

01. The Permanent Cooperative of the Management of the Project Structures. ( At least 2 hours)

 

Refer to the analyses carried out on the  permanent cooperative  for the management of the project structures part of the division of tasks in section 2 the division of tasks amongst the three project levels in the third block  solutions to the problems.

 

Review the 05.07 Statutes  of the Cooperative Association for he On-going Management of Project Structures of the Model.

Article 12 provides:

“Article 12: The Central Committee represents the Association. It may delegate some of its tasks to a general management which it elects and the activities of which it controls.

Property of the Association is held in the name of [name of the cooperative] "the Central Committee"
Property of the well commissions is held in the name of  [name of the cooperative]  "the Central Committee for the account of the [well commission in question]"
Property of the tank commissions is held in the name of  [name of the cooperative] " the Central Committee for the account of the [tank commission in question]"
Ownership of the local money structures is held in the name of [name of the cooperative]  " the Central Committee for the account of  [the local money structures]"
Ownership of the micro-credit structures is held in the name of [name of the cooperative]  “the Central Committee for the account of the [the micro-credit structure]" ”

The ownership and management of tribal and collectively-owned lands are important issues within the framework of integrated development projects, both in relation to the formal money sector and to the local money sector. From the paragraph on the traditional chiefs and land ownership it can be seen how the project structures make the management of tribal lands easier.

 

The issue of property is often very complex. Article 119 of the Venezuelan Constitution  (1999) provides :

“Article 119:

The State recognizes the existence of indigenous peoples and communities, their social, political and economic organization, their cultures, practices and customs, languages and religions, as well as their habitat and original rights to the lands they ancestrally and traditionally occupy, and which are necessary to develop and guarantee their way of life. 1. Opinion.

 

Make a two-page analysis of the land ownership systems in your project area and their relationship with integrated development projects. After a short introduction, describe traditional land tenure, then the formal rights recognised by the laws of your country. Then analyse the possibilities of «legalising » or «formalising » those rights within the framework of the permanent management of integrated development projects. What would be the reaction of  the chiefs and of the populations? In your conclusion analyse the risks, if you think there are any, linked with tribal lands in a world subject to economic  globalisation.

 

2. Research.

 

On one page, make a list of  traditional activities connected with tribal lands which would  be suitable for management within the framework of an integrated development project in your chosen area. Next to each item, note your explanation.

 

Drinking water supply structures include, amongst others :

 

Wells, boreholes.

Washing areas.

Hand-pumps.

Guard structures.

Solar pumps.

Photovoltaic panels and support systems

Land where well/borehole systems are placed.

Feed pipes.

Water tanks.

Land where water tanks are placed.

Operative centre for the maintenance of structures.

Maintenance equipment.

Spare parts stocks.

 

3. Research.

 

On one page, define the ownership of the above structures in terms of Article 12 of the Statutes. Watch out for activities placed in the hands of independent cooperatives !

 

Equipment and spare parts are purchased at central level. This is to obtain the benefits from bulk purchases and avoid eventual financing problems.

 

4. Opinion.

 

Suppose that a tank commission needs to replace the solar pump serving its tank. There are replacements for the pump in the project stores. On one page describe in detail exactly which procedure you think would be followed to get the new pump installed.. Attention should be  focused in particular on the registration of the ownership transfers involved.
